Welcome to maturebeauty.shop (the “Site”). These Terms & Conditions (“Terms”) are a legally binding agreement between you (“you,” “your”) and Mature Beauty Inc., a corporation organized under the laws of the State of Delaware, United States (“Mature Beauty,” “we,” “us,” or “our”).
These Terms govern your access to and use of the Site and your purchase of products through the Site.
By accessing or using the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Site.
1. Use of the Site
You may use the Site for personal, non-commercial purposes only. You agree not to:
- Copy, reproduce, modify, distribute, or exploit Site content without written permission
- Use the Site in violation of any applicable law
- Interfere with the operation or security of the Site
- Attempt unauthorized access to any systems or accounts
2. Eligibility
You represent that you are at least the age of majority in your jurisdiction and legally capable of entering into a binding contract.
3. Orders and Contract Formation
All orders are subject to acceptance by Mature Beauty. A binding contract is formed only when we send you an order confirmation email indicating that your order has been accepted and processed.
We reserve the right to refuse or cancel any order for reasons including product availability, pricing errors, suspected fraud, or payment authorization issues.
4. Pricing & Taxes
All prices are displayed in your local currency where available.
For customers located in the United Kingdom, prices include applicable Value Added Tax (VAT).
For certain international orders, including orders shipped on a Delivered Duties Paid (DDP) basis, applicable duties and taxes may be calculated and included in the purchase price at checkout.
Where duties and taxes are included in the purchase price, you should not be required to pay additional charges upon delivery. However, in certain circumstances beyond our control, local authorities or carriers may assess additional charges, for which you are responsible.
5. Payment & Electronic Communications
Payments are processed through Shopify Payments and authorized third-party providers. By submitting payment information, you represent that you are authorized to use the selected payment method.
By using the Site or placing an order, you consent to receive electronic communications from us, including emails, notices, and other communications relating to your orders, account, and these Terms. You agree that such communications satisfy any legal requirement that they be in writing.
6. Shipping & Risk of Loss
Shipping methods, costs, and estimated delivery times are provided at checkout. Delivery timelines are estimates and not guaranteed.
We remain responsible for the products until they are delivered to your designated delivery address.
Risk of loss passes to you upon delivery of the products to your designated delivery address.
International orders may be fulfilled using third-party logistics and cross-border shipping partners. We are not responsible for delays caused by customs processing or shipping carriers.
For certain international shipments, a third-party logistics provider may act as the importer of record on your behalf.
7. Force Majeure
Mature Beauty shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, supply chain disruptions, carrier delays, pandemics, or failures of third-party service providers. Our obligations will be suspended for the duration of such event.
8. Returns & Refunds
Returns and refunds are governed by our Return Policy, available on the Site.
Where applicable, refunds will include the purchase price and any taxes paid at checkout.
Duties and import charges, where applicable, may not be refundable depending on the policies of the relevant customs authorities.
Nothing in our Return Policy affects your statutory rights under applicable consumer protection laws.
9. User Accounts & Password Security
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
10. Reviews & User Content
If you submit content, you grant Mature Beauty a non-exclusive, royalty-free, worldwide license to use and display that content. You represent that you have the rights to submit it.
11. Intellectual Property
All Site content is owned by or licensed to Mature Beauty and protected by intellectual property laws.
12. DMCA Notice
If you believe content infringes your copyright, you may submit a DMCA notice to support@maturebeauty.shop including the required statutory information.
13. Disclaimer of Warranties & Cosmetic Product Disclaimer
The Site and all products are provided “as is” and “as available,” without warranties except as required by law.
Cosmetic Product Disclaimer
Our products are cosmetic products intended for external use only. Individual results may vary. You are responsible for reviewing the ingredient list prior to use to ensure you do not have sensitivities or allergies. We recommend conducting a patch test before full application.
Discontinue use immediately if irritation occurs and consult a qualified healthcare professional if necessary.
Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements made on the Site have not been evaluated by the U.S. Food and Drug Administration.
14. Limitation of Liability
To the maximum extent permitted by law, Mature Beauty shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or business interruption.
To the fullest extent permitted by applicable law, our total cumulative liability arising out of or relating to any product purchased through the Site shall not exceed the total amount paid by you for the specific product giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Mature Beauty from any claims arising out of your violation of these Terms.
16. Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this section carefully as it affects your legal rights.
Binding Arbitration
Any dispute arising out of or relating to these Terms, your use of the Site, or purchase of products shall be resolved exclusively through final and binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.
Arbitration shall be administered by a recognized arbitration provider in the United States and conducted in accordance with its applicable rules. The arbitration shall take place in Delaware unless otherwise required by law.
Class Action Waiver
You agree that disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Jury Trial Waiver
You and Mature Beauty waive the right to a trial by jury for any dispute arising under these Terms.
If any portion of this section is found unenforceable, the remaining portions shall remain in effect.
If you are a consumer located outside the United States, including in the United Kingdom, nothing in this section limits your right to bring claims before your local courts where required by applicable law.
17. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
However, if you are a consumer located outside the United States, you may benefit from mandatory provisions of the laws of your country of residence.
18. Entire Agreement
These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Mature Beauty and supersede prior agreements or understandings.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
